Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the app "Daily Brain 5" (the "app") provided by foco apps ("we", "us"). By using the app, you agree to these Terms. If this English version and the Japanese version differ, the Japanese version prevails.

1. The app

  1. The app offers daily puzzles and a record of your play.
  2. The app is not intended to diagnose, treat or prevent any disease, or to improve any health condition.
  3. For the app obtained from the App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies. Where they differ, these Terms prevail to the extent permitted by law.

2. Paid features

  1. The app offers the auto-renewing subscription "Daily Brain 5 Premium" (yearly and monthly), a one-time purchase that removes full-screen ads, and hints (consumable). Prices and periods are shown on the purchase screen before you buy.
  2. A subscription renews automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Cancel in iPhone Settings → your name → Subscriptions. After cancelling, you can use it until the end of the period you have paid for.
  3. If the yearly plan includes a free trial, it becomes a paid subscription when the trial ends and you are charged, unless you cancel at least 24 hours before the trial ends. The App Store decides whether you are eligible for a free trial.
  4. Payment and refunds are handled by Apple under Apple's terms. We cannot issue refunds directly.
  5. Purchases are tied to your Apple ID. Subscriptions and the ad removal can be restored with Restore purchases on devices signed in with the same Apple ID.

3. Hints

  1. Hints can be used only within the app. Purchased hints do not expire.
  2. Hints cannot be exchanged for cash, other products or the currency of other apps, and cannot be transferred to anyone else.
  3. Hints are consumable and are not covered by Restore purchases. Your remaining hints may not come back if you delete the app or use Delete all data on this device.
  4. Except where required by law, used or remaining hints are not refundable.

4. Ads

The app shows ads. You choose whether to watch rewarded ads. Advertisers are responsible for their ads, and sites or services you reach from an ad have their own terms.

5. What you must not do

  1. Break the law or public order.
  2. Modify, reverse engineer, copy or redistribute the app, except as permitted by law.
  3. Change purchases, hints or records by improper means.
  4. Infringe the rights of the app, us or others, or interfere with the operation of the app.

6. Rights

Rights in the app's software, puzzles, images and text belong to us or their rightful owners. These Terms grant no rights other than to use the app personally.

7. Changes and ending the service

  1. We may change the app or stop providing it. Before ending a paid feature, we will announce it in the app in advance wherever possible.
  2. The app has no account and stores your progress on your device. Progress cannot be carried over when you change devices or delete the app.

8. Liability

  1. We do not promise that the app will always work, be free of bugs, or suit any particular purpose.
  2. We are not liable for damage arising from the app except in cases of our intent or gross negligence. Where the law (such as Japan's Consumer Contract Act or the law of your country) does not allow this limit, the law applies.
  3. Where we are liable, except in cases of our intent or gross negligence, our liability is limited to the amount you paid for the app in the 12 months up to the month in which the damage occurred.

9. Changes to these Terms

We may change these Terms in accordance with the law. We will announce the changes and the date they take effect on this page and in the app in advance.

10. Governing law and courts

These Terms are governed by the laws of Japan. The district court with jurisdiction over the operator's address has exclusive jurisdiction in the first instance over disputes about the app. This does not prevent a consumer from bringing a claim in the courts where they live, where the law allows it.
